Surprise, surprise! Even though last year the IRS announced, under pressure from Congress, that it would stop pursuing American businesses that have had no ties to drug dealing, money laundering or other illegal activities in their Civil Asset Seizure program, it seems nothing has really changed. Recently the IRS turned the life of a small business owner in North Carolina upside down and inside out by seizing $107,000 from his bank account.
I’ve written about the practice of Civil Asset Seizures in the past, but for those of you who may not know, it is a law that gives the government authority to seize money from regular folks, either individuals or businesses simply based on the pattern of cash deposits under $10,000.

The ways of getting into IRS trouble seem endless. One way that often takes taxpayers by surprise is when the person who prepared their tax returns is indicted for fraud. It’s a guilt-by-association situation. All the individuals or businesses whose returns were filed by the preparer are immediately implicated in the fraud.
A tax preparer faced with this kind of allegation will most certainly know they should retain experienced tax counsel. The tax-filer on the other hand, may not be aware of the impact and may hesitate to retain counsel. It is a difficult situation to fully understand for someone who is not a professional preparer.

Most taxpayers are aware that there are blatant mistakes that will cause the red flags to fly at the IRS. Yet there are those who are willing to get very creative at tax time to save a little money. The typical areas that most attempt to play dangerously in are fairly consistent. However, others take their creativity seriously and not only trigger audits, but lots of laughs.
The IRS is not the best audience for comedy routines. So don’t try any funny business with them. And do keep in mind that the IRS recently announced it will not require taxpayers to amend their returns or pay back any extra money received in their refunds due to incorrect health care-related tax information on Form 1095-A.

Filing taxes is no laughing matter, as anyone who’s tangled with the IRS knows. However, some taxpayers have wildly creative ideas of what constitutes a legitimate claim and come up with some that are outrageously funny. They’re generally fatal too, if they make it through to the IRS.

Have you ever heard of a “water computer”? Me neither until I saw this on AccountingToday.com. One CPA actually had to tell a client they could not claim their sailboat as a “water computer”!
