Make No Mistake. Make This Your Mantra for This Year’s Tax Return

March 30th, 2015 → 8:00 am @ // No Comments

Mistakes happen. We do our best to avoid them, but we’re all human and things do slip through the cracks of our minds! At tax time, though, we want to be super human especially if we’re owed a refund from the IRS. So, whether you prepare your own taxes or have them prepared for you, you need to be diligent in going over your return carefully before sending them in.

Remember, if you’re owed a refund, even a careless mistake such as not dating your return can delay that refund check. And, if you owe the IRS money, you’ll need to send it in with your return.

February 23rd, 2015 → 10:01 pm @ // No Comments

Not only did song and dance playwright, George M. Cohan lead the way on Broadway, he also broke new ground with the IRS. Cohan who wrote Broadway hits like “Give My Regards to Broadway” and “Yankee Doodle Boy” paid for much of his travel and entertainment with cash and was bold enough to go up against the IRS when, back in the 1920’s they denied all his deductions.

We all know how important it is to keep our receipts in case we ever get audited, especially travel and entertainment receipts the IRS already looks upon with suspicion. However, most people don’t know about or think about the Cohan case.

Chapter 11 Bankruptcy is also known as “reorganization.”  Very often the business continues to function with Chapter 11 Bankruptcy. Chapter 7 Bankruptcy for a business requires liquidation of all assets.  A court appointed trustee is assigned to oversee the sale of the assets and to oversee the entire bankruptcy process.

Using Withheld Payroll Taxes For Other Expenses is Dangerous Business

November 6th, 2014 → 3:33 pm @ // No Comments

Unfortunately many employers fall into this very dangerous trap during financially stressful times. Be forewarned though that any other means of meeting financial obligations is preferable to using payroll taxes.

Any individual within a company who distributes payroll checks to anyone considered an employee is automatically considered a trustee for the U.S. government. A percentage of the payroll taxes that are withheld are called “trust fund taxes” and belong to the government.

If payroll taxes are misused to pay other expenses instead of making payment to the IRS, they will assess what is called a trust fund civil penalty also known as a trust fund recovery penalty (TFRP).
